A BILL to amend article one, chapter sixteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section four,
relating to the state bureau of public health; medicaid
waivers for aged and disabled persons; and directing the
secretary of the department of health and human resources to
request five hundred additional waivers from the appropriate
federal agency.
Be it enacted by the Legislature of West Virginia:
That article one, chapter sixteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section four,
to read as follows:
ARTICLE 1. STATE BUREAU OF PUBLIC HEALTH.
§16-1-4. Secretary directed to seek additional medicaid waivers.
The secretary is hereby directed to request the federal
health care and financing administration for five hundredadditional medicaid waivers for aged and disabled persons in West
Virginia under Title XIX of the "Social Security Act" that are
necessary to enable this state to deposit all federal payments
under those programs in the state treasury to the credit of the
state commission on aging created by article fourteen, chapter
twenty-nine of this code.
NOTE: The purpose of this bill is to direct the Secretary
of the Department of Health and Human Resources to request the
federal Health Care Financing Administration to request 500
additional medicaid waivers for aged and disabled persons under
Title XIX of the Social Security Act.
